Judge Huvelle, U.S. District Judge for the District of Columbia, issued an opinion and order declaring the provision inserted into the final FY 2010 Department of Transportation, Housing and Urban Development and Related Agencies Appropriations bill by Senator Patty Murray (D-WA) unconstitutional as a violation of the 1st and 5th Amendments.
